Self-Defense and Understanding Japanese Law: The Concept of Justifiable Defense (Seitō Bōei no Rikai)

What is Justifiable Defense?

According to Article 36 of the Japanese Penal Code, justifiable defense is recognized under the following conditions:

  • The danger is imminent and unlawful
  • The action is necessary and unavoidable
  • The response is proportionate to the attack

Excessive Defense?

Excessive use of force beyond the scope of self-defense is punishable.

  • Hitting the opponent multiple times after they stopped attacking → Excessive defense
  • Using a weapon for a light push → Highly likely to be excessive defense

Is Weapon Use Allowed?

Under Japanese law, possessing weapons for self-defense is illegal. Even using everyday items may cause problems depending on the circumstances.

Can You Protect Others?

Yes, but the following conditions must be met:

  • The person is under imminent unlawful attack
  • The action is limited to the minimum necessary
